Agreement Waiver and Indemnity

By purchasing a lunch package from Pita Pit, the purchaser agrees to the following:

Terms and Conditions for the Sale and Supply of Catering Goods: ‘Round the Bays’ Events

These terms and conditions (“Terms”) govern the sale and supply of catering goods (“Goods”) by Pita Pit ("we," "us," or "our") to customers (“you" or "your") for the ‘Round the Bays’ events in Wellington, Christchurch, and Auckland (collectively referred to as "RTB Events"). By placing an order, you agree to these Terms.

1. Order Placement and Confirmation

1.1 All orders for Goods must be submitted and confirmed no later than 4 days prior to the scheduled RTB Event. Wellington ordering deadline – Wednesday 12^th Feb 12pm. Auckland ordering deadline – Wednesday 26^th Feb 12pm. Christchurch ordering deadline – Wednesday 26^th March 12pm.

1.3 Orders are considered confirmed upon receipt of a confirmation email from our team.

2. Delivery and Coordination

2.1 Delivery of the Goods will be coordinated in conjunction with the RTB Event organisers to ensure timely and accurate delivery to the designated location.

2.2 Specific delivery times and locations will be communicated to you at least 24 hours before the event.

2.3 We are not responsible for delays caused by circumstances outside our control, including but not limited to event schedule changes or access restrictions at event venues.

3. Allergen and Dietary Requirements

3.1 If you have specific allergen requirements or need to adjust your order for any reason, please notify us at events@franchise.pitapit.co.nz as soon as possible. Please see this LINK for allergen and nutritional information.

3.2 We will make all reasonable efforts to accommodate your requests, but adjustments made within 48 hours of the event cannot be guaranteed.

3.3 While we take precautions to prevent cross-contamination, we cannot guarantee that Goods will be free from traces of allergens.

4. Pricing and Payment

4.1 All prices for Goods will be communicated at the time of order placement and are inclusive of GST unless otherwise specified.

4.2 Full payment must be made before the scheduled delivery. Orders will not be delivered without receipt of payment.

4.3 Payment method by credit card. Details will be provided upon order confirmation.

5. Cancellations and Refunds

5.1 Cancellations must be made no later than 96 hours prior to the RTB Event.

5.2 If a cancellation is made within the allowable timeframe, we will act in good faith and may process a full refund.

5.3 Cancellations made less than 96 hours before the event may incur a charge of up to 50% of the order total to cover preparation costs.

6. Liability

6.1 We shall not be liable for any indirect, incidental, or consequential damages arising from the supply of Goods.

6.2 Our liability for any claims related to the supply of Goods will not exceed the total amount paid for the order.

7. Force Majeure

7.1 We are not responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, transportation disruptions, or other unforeseen events.

8. Miscellaneous

8.1 These Terms are governed by the laws of New Zealand.

8.2 Any disputes arising under these Terms will be resolved through negotiation in good faith.

8.3 We reserve the right to update these Terms at any time. Any changes will be communicated to you and will not affect orders already confirmed.
