Terms & Conditions

By entering, participating and/or competing in the Round the Bays event (the “Event”), I (“Participant” or “I”) acknowledge and agree to the following terms and conditions, which may be updated by Stuff Limited (“Stuff”) from time to time without notice.

1. Entry, Event Rules and Disqualifications

1.1 I declare that all information supplied by me in the entry form is true and correct. My Event entry is personal and may not be transferred without Stuff's consent. Entries may be able to be transferred via the official ticketing platform for the Event.  A transfer fee and associated costs will be applied and charged at the time of transfer online.

 1.2 I understand that should my contact details change after my registration is completed, it is my responsibility to notify Stuff at roundthebays@stuff.co.nz or through the official ticketing platform.

1.3 I certify that I am 18 years or older or, if I am the parent or legal guardian of a Participant under 18, I consent to these Terms on their behalf. Participants under 13 must be supervised by a responsible adult at all times.

1.4 I must wear the official race bib on the front of my t-shirt or top and display my allocated race number clearly, follow the approved course and observe traffic rules and instructions from officials.  

1.5 Stuff may reject or cancel my entry, or disqualify me at any time, including for safety or insurance reasons, or if I am unable to complete the Event within the cut-off times. If this occurs, I am responsible for my own actions and support arrangements, and no refund will be given.

1.6 Stuff may disqualify or remove any Participant whose behaviour is inappropriate, offensive, unsafe or likely to endanger others or property. Items that may present risks (including bicycles, scooters, roller blades, drones or other equipment) are not permitted unless expressly approved by Stuff in writing. Participants must not be under the influence of alcohol or drugs on the course.

1.7 As above, any equipment that may cause injury to myself or others is not permitted. Prior approval must be obtained from Stuff if any structure (other than prams or wheelchairs) is intended to be pushed, towed or carried during the Event. Approval can be obtained by contacting Stuff at roundthebays@stuff.co.nz.

1.8 Starting before my assigned start time will result in disqualification.

1.9 The Event Director's decision is final and no correspondence will be entered into.

2. Prizes and Race Bib Collection

2.1 I will only be eligible for any prize offered in connection with placing at the Event if I complete the approved course by the indicated cut-off times and in accordance with these terms and any other Event rules notified to me.

2.2 I am responsible for collecting my Event race bib from the designated collection venue or nominating someone to collect it on my behalf.

3. Timing Services

3.1 Timing services are provided by contracted timing service providers. Stuff takes no responsibility for errors or omissions in the timing data or if a Participant's timing tag is damaged and cannot record an official race time.

4. Health, Safety and Personal Responsibility

4.1 Stuff organises and hosts the Event and recognises its obligations as a Person Conducting a Business or Undertaking (“PCBU”) under the Health and Safety at Work Act 2015. Event planning and risk management procedures are in place to help ensure, so far as reasonably practicable, the health and safety of all Participants.

4.2 I must take all reasonable steps to look after my own safety and the safety of others.

4.3 I must report any hazards immediately to Event officials on the Event day or by emailing roundthebays@stuff.co.nz.

4.4 I certify that I have undertaken sufficient training, am medically fit to participate, and am not aware of any condition that may endanger myself or others.

5. Medical Assistance and Emergencies

5.1 I consent to receiving any medical assistance deemed advisable by official medical personnel during the Event.  

5.2 My personal information may be shared with these personnel in the event of an emergency.  I must include accurate information about any known medical conditions and emergency contact information on my entry form and on the back of my bib and keep details current.

6. Assumption of Risk and Indemnity

6.1 I acknowledge that participating in an outdoor event entails inherent risks, including but not limited to inclement weather, uneven terrain, potential collisions with others or the spread of communicable illnesses. I assume all such risks, whether foreseen or not.

6.2 To the fullest extent permitted by law, I release and indemnify Stuff (including its directors, officers, employees, contractors, volunteers, sponsors and partners) from any liability arising directly or indirectly from my participation, except to the extent any negligent conduct by Stuff cannot lawfully be excluded or restricted. This indemnity includes costs incurred in defending or settling any claim brought against Stuff.

7. Changes, Cancellation and Refunds

7.1 Stuff may modify, postpone or cancel the Event if circumstances (including inclement weather, force majeure, or safety concerns) make it reasonably necessary.

7.2 Where possible, changes will be published on the Event website and/or via Event e-newsletters and/or via social media, as well as notifying Participants via email.

7.3 Stuff is not liable for any costs I incur (including travel or accommodation) as a result of any modification, rescheduling or cancellation of the Event.

7.4 As a general rule, no refunds will be issued for any Event entries, including where the Event is cancelled or rescheduled for any reason. Stuff will not be responsible for any costs incurred as a result of the Event being cancelled or rescheduled, except as required by law. However, if I provide a valid medical certificate before 5:00pm (NZT), 10 working days prior to Event day, Stuff may, at its sole discretion, refund the entry fee only (excluding any transaction or service fees). Refunds for additional merchandise or donations will not be made.

8. Personal Information, Privacy, Media and Photography

8.1 I have read and consent to the terms of Stuff's Privacy Policy (available on Stuff's website), which applies to how my personal information is collected, used and protected. I may request correction of my personal information at any time by emailing privacy@stuff.co.nz.

8.2 By entering the Event, either myself directly or via my Team Manager, I consent to Stuff and its related companies, business units and departments (including Stuff Digital Limited, Neighbourly Limited) collecting, storing and using my personal information for administration of the Event, and for marketing and promotional purposes. This may include sharing my personal information with Event sponsors, charities, or fundraising platforms if I have selected to donate or fundraise.

8.3 I authorise Stuff and its related companies, sponsors, partners and fundraising platforms to record and use my name, image, voice, statements, and Event results in any form of media, online or in print, for marketing or promotional purposes related to the Event or future similar events without payment or compensation.

8.4 If I select to become a member of a team, the team manager will have access to download my personal details, including my name, date of birth, contact telephone number, email address and home address. As a team manager, my email address will be disclosed to my team members (but not to members of other teams).

8.5 Team managers who submit entry forms on behalf of their team members undertake to make each team member aware of these terms and conditions. Stuff reserves the right to cancel any entry made by a team manager at any time for any reason, including if the team manager does not have the requisite authority to enter that team member.

9. Promotional Codes and Resale Restrictions

9.1 Promotional codes must only be used in accordance with the conditions under which they are issued, including any validity period. If these conditions are not adhered to, the entry may be cancelled without refund and the bearer of the entry may be refused entry. Entries may not be resold or offered for resale without Stuff's prior written consent. Any entry that is resold or used in breach of these conditions may be cancelled without refund.

9.2 Stuff reserves the right to modify, suspend, or cancel any promotional code(s) at any time without notice. No refunds will be made to Participants who had access to a promotional code but did not use it at the time of purchase.

9.3 Promotional codes cannot be redeemed or exchanged for cash and must only be used by the Participant(s) to whom the code was issued.

10. VIP Add-On

10. 1 Entry to the VIP area at the Finish Line is open to all ages, however guests aged under 18 years must be accompanied by a parent/caregiver at all times. All participants must wear their VIP bib to gain access to the VIP area.

10.2 The VIP Add-On is available through the ticketing flow, subject to availability, by paying the applicable upgrade fee at the time of signing up or as an additional purchase via their participant dashboard store.

10.3 No food or beverage is to be brought into the VIP area.

10.4 Smoking or vaping is not permitted inside, or in the vicinity of, the VIP area.

10.5 The VIP Add-On is non-transferable and non-refundable.

10.6 Tjhe VIP Add-On is available to all ages, however no child or concession discounts apply.

10.7 The VIP goodie bag must be collected from Bib Collection before event day.

Half Marathon Terms & Conditions

These Event terms must be adhered to by those taking part in the Half Marathon, in addition to the general Participant terms and conditions.

1. A Half Marathon entry is strictly restricted to participants aged 16 years old or over on race day.

2. As a Half Marathon participant you confirm that you are physically fit and have carried out sufficient training to complete the Half Marathon course without risk to your health.

3. Participants must follow the certified Half Marathon course layout. Any short-cuts will automatically result in disqualification.

4. Participants must follow the cut-off times as advised by on-course marshalls, for the safety of all participants. Full cut-off time restrictions are available on our FAQ's page.
